Welcome to MadJack AI Solutions ("MadJack", "we", "us", or "our"). By accessing or using our platform at madjackai.com and all associated subdomains (collectively, the "Service"), you agree to be bound by these Terms of Service.
By creating an account or using any MadJack tool, you agree to these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.
MadJack provides AI-powered business tools including but not limited to: SEO optimization, social media management, paid advertising management, CRM, email marketing, booking and scheduling, customer support, proposal generation, and analytics. These tools are offered on a subscription basis through our marketplace.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
MadJack tools are offered on monthly subscription plans. Prices are listed on our marketplace. By subscribing, you authorize us to charge your payment method on a recurring basis. You may cancel at any time, and your access will continue until the end of your current billing period.
Some features may incur usage-based charges (such as AI image or video generation). These charges will be clearly communicated before they are incurred, and you will be billed at the end of each billing cycle for any overage usage.
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to our systems; (c) upload malicious code or content; (d) use the Service to send spam or unsolicited communications; (e) resell or redistribute the Service without authorization; (f) use the Service to generate content that is defamatory, obscene, or infringes on third-party rights.
MadJack uses artificial intelligence to generate content including text, images, and videos. While we strive for high quality, AI-generated content may contain errors or inaccuracies. You are responsible for reviewing all AI-generated content before publishing or distributing it. MadJack does not guarantee that AI-generated content will be free from errors, biases, or intellectual property concerns.
The Service integrates with third-party platforms including Meta (Facebook, Instagram), TikTok, LinkedIn, Pinterest, YouTube, X (Twitter), Google, and others. Your use of these integrations is subject to the respective third party's terms of service. MadJack is not responsible for the availability, accuracy, or policies of third-party services.
You retain ownership of all content you create or upload to the Service. You grant MadJack a limited license to process, store, and display your content as necessary to provide the Service. Content generated by our AI tools on your behalf is owned by you upon generation.
MadJack is provided "as is" without warranties of any kind. To the maximum extent permitted by law, MadJack shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We will make your data available for export for 30 days following termination.
We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
Subscriptions are billed in advance on a monthly basis. We do not offer refunds for partial months. If you believe you were charged in error, contact us within 30 days at hello@madjackai.com and we will review your case. Usage-based charges (AI image and video generation) are non-refundable once the content has been generated.
You agree to indemnify and hold harmless MadJack AI Solutions, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from: (a) your use of the Service; (b) content you create, publish, or distribute through the Service; (c) your violation of these Terms; (d) your violation of any third-party rights, including intellectual property or privacy rights.
Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the State of Florida. Each party shall bear its own costs. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction of the state and federal courts located in Florida for any disputes not subject to arbitration.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and MadJack regarding the Service. Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Assignment: You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights without restriction.
